Moving to predatory due to these new terms:

4.1.1.2

pay the Affiliate on a monthly basis depending on the traffic generated subject to these T&C.

The Affiliate will be entitled only to those earned and unpaid commissions as of the effective date of termination; however provided, the Company may withhold the Affiliate’s final payment for a reasonable time to ensure that the correct amount is paid. The Affiliate will not be eligible to earn or receive commissions after this date; - needs to stipulate 90 days

Another alarming term:

"Notwithstanding anything to the contrary, in case of Your breach or threatened breach of any of the provisions of this Agreement as well as any direct violation thereof, You shall be liable to pay a penalty of fifty thousand Euro (€50,000) to Us for each such individual breach or threatened breach of this Agreement as provided herein (hereinafter referred to as 'Penalty'). The payment of the Penalty shall be without prejudice to Our right to claim compensation for any damage (including without limitation any indirect or consequential damage, loss of profits or any expenses incurred in relation to the breach or threatened breach) that exceeds the Penalty, which right shall not be affected nor limited by the payment of the Penalty. Furthermore, without prejudice to the Penalty, We shall be entitled to seek any equitable relief as a remedy for such breach, including injunctive relief concerning any threatened or actual breach of any of the provisions of this Agreement as well as any direct violation thereof.

The Penalty becomes due as of the moment of the occurrence of the breach or the moment of threatened breach, and if this is not paid on the first demand, the late payment interest in the maximum amount allowed by the Laws of Malta shall accrue."

Very aggresive amounts (50€k) - What kind of vialations does that mean?
Is it like if they get problems with MGA becouse of some affiliate or can it be as simpel as the affiliate havent made enugh effort to promote the casino?

I`m asking in general also, any experience of such terms?

These terms never used before as my AM told me. They are just there in case any affiliate want intentionally to harm the brands, that was the answer i got.

That is the lamest excuse that AM could've possibly come up with. If this would be the case, then exactly the subset "only in proven case any affiliate want intentionally to harm the brands" has to be added to each and any of the predatory terms.

The other 5 predatory terms listed in this thread are telling the whole story about the program.

Terms are not a subject of random interpretation. They are the legal basis, even if most if not all AM believe, they are are joke.

All of these offshore constructs in many cases have no chance to force such a penalty. For example for a German webmaster it's a legal standard, they have to come to Germany and try to sue here. The place of jurisdiction is here in Germany and not at their underground maildrop.

All of our courts would dismiss the case within seconds, because contracts with all casino affiliate programs under our law are contra bonos mores, means void and invalid. They have no chance to get one Cent from anybody here.

Of course, on the other side, you cannot sue them if they don't pay.

Hi Alchemist,

I can only speak for my country, and we have grant of inspection of court files also in civil case, so If an online casino has no real office in my country with a summonable address, then I would write one single letter back to them or their money-laundering-specialist-lawyer to explain, that they are holding the short end of the stick in my court.

Such penalties are a psychological operation by lowlife programs, who believe, they can intimidate and blackmail their affiliates.

We had several cases here in Germany, where Casinos like Quasar refused to payout winnings of 100.000+ Euro, all with a Malta license. So much for Malta.

After Malta, the most corrupt country in the EU, without any doubts ruled by the Italian Mafia, after they killed with a conspiracy investigative journalist Daphne Caruana Galizia, mother of a son, with a car bomb on Malta on 16. October 2017, because she was close to publish the evidence of connections between Malta Government, highest level of Malta Police, online Casino Industry and the Mafia. since this Giovanni Falcone like assassination no one ever again shall tell me, that this industry is not evil.

I was the only one who has reported about this on GPWA, and they have been all silent.

Hey thanks for your answer,

Everything and everyone gets corrupted when it comes to money.
We can't change it and if you try hard, you get killed like the reporter you said.
In a bigger picture, the economic system we have now sucks big time but we keep having it.
You see it with this virus, it destroyed everything but hey no worries let's print more money.
Then this money will be paid by people of course that just want to live quietly.
The corrupted ones will be untouched.
For example here in Greece, you HAVE to be corrupted in order to make more money.
We think our politicians are corrupted but we never thought that they have to be in order to be politicians.

A little bit out of topic for sure as this is a thread for Affmore, just saying.
