Payment for Commissions is dependent upon Clients providing such funds to Windstorm Tech LLC, and therefore, you agree that Windstorm Tech LLC shall only be liable to you for Commissions to the extent that Windstorm Tech LLC has received such funds from the Clients. Thanks for raising this - it’s a fair question.

The clause you've highlighted is part of our standard legal terms and isn't intended to change the agreed commercial deal with our affiliates. CPA, Hybrid and Revenue Share agreements are honoured in accordance with the terms agreed between us.

We usually negotiate such terms on a case-by-case basis and I'd be delighted to discuss anytime on Telegram @LuckyBuddhaAffiliatesTeam if you would like.

Our programme terms have recently been reviewed and certified by Affiliate Guard Dog, but I appreciate your feedback on this wording and will raise it internally to see if it can be clarified.

Remedies - In addition to any other rights and remedies available to us under this Agreement Windstorm Tech LLC reserves the right to delete any actions submitted through your Links and withhold and freeze any unpaid Commissions or charge back paid Commissions to your account if (i) Windstorm Tech LLC determines that you have violated this Agreement, (ii) Windstorm Tech LLC receives any complaints about your participation in the Affiliate Program which Windstorm Tech LLC reasonably believes to violate this Agreement or(iii) any Qualified Action is later determined to have not met the requirements set forth in this Agreement or on the Affiliate Program. Such withholding or freezing of Commissions, or charge backs for paid Commissions, shall be without regard as to whether or not such Commissions were earned as a result of such breach.

I may have misread this, but the remedies clause appears to imply a blanket forfeiture. If a player is flagged as fraudulent, duplicate or unqualified, all your commissions could be frozen, not just those of the affected players.

That doesn't seem very friendly.

In this case, the wording is based on the standard Affise agreement template that we've adopted.

Our intention is straightforward: legitimate affiliate earnings are not something we're looking to withhold. Any reversals would relate to fraudulent, duplicate or otherwise invalid player activity, not genuine qualified referrals. We have various 3rd party technologies to help verify fraudulent transactions together.
