Due to these terms:
"Additionally, the payment shall be made only for accepted leads up to the amount of the approved test cap which shall be 10 FTD per month. If the agreed traffic quality or activity conditions are not met at the time of invoicing, payment for the corresponding leads shall be postponed and carried over to the following payment period.
11.5. Performance and Activity Standards
11.5.1. Affiliates must refer at least 15 new Active Players within any rolling 90-day period.
11.5.2. If not met, the account is "Dormant", and RevShare is reduced to 5%.
11.5.3. After 180 days of inactivity, a monthly fee of 50% of the balance is applied.
11.5.4. After 270 days, the Elevare Marketing Limited will close the account and de-tag all previously referred players, ceasing all future commissions.
Elevare Marketing Limited reserves the right to amend, modify, replace or change the applicable Commission Structure, Commission rates, calculation methodology, attribution logic, and/or Hold Periods in accordance with this Affiliate Agreement. Any such changes shall apply prospectively from the time of implementation.
6.14 Unilateral Changes to Commission Calculation
Notwithstanding anything else in this Affiliate Agreement, Elevare Marketing Limited reserves the right, at its sole discretion, to amend, modify, replace or change, at any time, the method, formula, structure and/or basis of Commission calculation and/or attribution, including without limitation:
(a) Revenue Share percentages;
(b) the definition and composition of Net Revenue;
(c) CPA, Hybrid or other Commission Structures;
(d) thresholds, caps, multipliers, performance metrics or KPIs;
(e) attribution, tagging, tracking logic or player allocation rules.
Such changes may take effect immediately upon implementation and shall apply prospectively. Elevare Marketing Limited shall have no obligation to provide prior notice to the Affiliate. The Affiliate acknowledges that it has no vested or accrued right to any specific Commission calculation method, structure or rate.
6.2.1. If the Affiliate claims the Commission after the 6 (six) months from the date of occurrence of this Commission, Elevare Marketing Limited reserves the right to pay this Commission within 6 (six) month after the receiving of the Affiliate's claim (the whole amount or in parts at the discretion of Elevare Marketing Limited)
2.4.2. Technical KPIs: Elevare Marketing Limited reserves the right to deem traffic "Low Quality" if:
(a) The Repeat Deposit (RD) to First Deposit (FD) ratio is below 40%;
(b) Total wagering (Turnover) is less than three times the total deposits (SumBets < 3x SumDep).
2.4.3. Sanctions: For such traffic, Elevare Marketing Limited may extend the Hold up to 180 days or unilaterally convert all commissions to a 5% Revenue Share model."
