Due to these terms:
Performance Rules
This Agreement and your participation in the Affiliate Program shall terminate if:
in the First Calendar Year, the number of new Acquired Customers assigned to your Affiliate Account is less than the Minimum Number of New Acquired Customers described in Section X.2; or in any Calendar Period, the number of new Acquired Customers assigned to your Affiliate Account is less than the Minimum Number of New Acquired Customers for such Calendar Period as described in Section X.3.
In the First Calendar Year, the Minimum Number of New Acquired Customers shall be one.
The Minimum Number of New Acquired Customers for a Calendar Period shall be dependent on the aggregate commission paid to the Affiliate in the previous Calendar Year, as determined by the following table:

Tipico Services shall calculate whether you have achieved the Minimum Number of New Acquired Customers for:
the First Calendar Year, within 14 days following the end of the First Calendar Year; and a Calendar Period, within 14 days following the end of such Calendar Period.
To the extent that you have failed to achieve the Minimum Number of New Acquired Customers in the First Calendar Year or in a Calendar Period as described above, Tipico Services shall notify you of such failure and this Agreement and your participation in the Affiliate Program shall be deemed to have automatically terminated with effect from the date on which you receive such notice.
If this Agreement is terminated pursuant to clause 6, any performance-based commission generated by the Affiliate during the period between the end of the First Calendar Year or the end of the relevant Calendar Period (as the case may be) and the date on which the Agreement is deemed to have terminated shall be paid to the Affiliate in accordance with Section XI.5(e)
