Looking for Insights: What Do Affiliates Consider Fair or Unfair in T&Cs?

Hey everyone

I'm currently drafting an Affiliate Terms and Conditions document for a new project, and I want to make sure we're doing things right. I'm especially interested in understanding what affiliates generally consider fair, and what terms tend to raise red flags or frustrations.

If you're an affiliate or have experience in the space, I'd really appreciate your thoughts. What do you like to see in a partnership agreement? What makes you walk away?

I'm also open to discussions if you'd like to dive into the details together.

What I like to see in TC:
- % of admin fee
- How NGR is calculated
- Min. threshold for payment

Red flags:
- any minimum quotas of FTDs or active players needed for account to stay active and commission to be paid out
- high admin fee
- no transparent data such as hiding withdrawals in reports and other data which allows us to calculate earnings ( that can not be seen in TC but anyway)

What makes me walk away:

- KYC: affiliates are not customers
- Minimum Quotas as @CasinoDotReview mentioned
- Retroactively changed terms
- Manipulated numbers (inside the platform)

What makes me stay:

- If i don't have to contact the affiliate manager for ANY reason other than saying hi!

Thanks for sharing your thoughts — I’m very much aligned with your stance on transparency. It’s something I value highly as well.

I wanted to explore a couple of the red flags you mentioned a bit further:
- Do you think it’s reasonable to mark an affiliate account as inactive if no new FTDs are brought in within 6 months? From an affiliate manager’s perspective, it helps keep things streamlined, but I’m aiming for a balance that’s fair and respectful to affiliates as well.
- Also, what would you personally consider a “high” admin fee? From what I’ve seen, 25% seems to be a common benchmark — would you say that’s accurate or leaning too high?

Would love to hear your take!

Thanks for your input — totally agree with you on the KYC payout and manipulation issues. I’ve come across that myself, and it always struck me as weird and frankly, distasteful.

Same question to you:
- Do you think it’s fair to mark an affiliate account as inactive if no new FTDs are generated within 6 months? From the affiliate manager side, it helps keep the program clean and manageable, but I’m trying to strike a balance that’s both effective and respectful to affiliates.
- Also, about retroactively changed terms — could you share an example from your experience (or even a hypothetical if it’s too specific)? I imagine you’re referring to changes made in bad faith, rather than a company’s reasonable right to update and evolve its T&Cs over time.

Personally, my goal is to set things up so that my only real job is chatting with affiliates about how their day is going So it feels like we’re very much on the same page here.

hey @George V.

From my experience, adding any quota is bad, i would try to avoid it if i had an affiliate program. The reason is that the affiliates can simply drop my brands and go promote other brands.

About the terms yes, i mean in bad faith. Some programs for example adding the minimum quota or a higher payout after some time just to make it harder for the affiliates to achieve. Imagine a scenario where the affiliate promotes a brand and then after 2 years the brand is adding a monthy minimum 5 ftds. Then the affiliate is not able to get paid.
