My Earnings + Legal Questions

Hello to everyone on this forum. I have been doing both casino and poker affiliate marketing now for the last 3 years. Up until this time I have been promoting sites in the US as this is also where I am located. My earnings have eclipsed over 30k a month after 3 years of hard work. Am I liable to get in trouble promoting these casinos in the US as an affiliate? Since the earnings are started to grow rapidly I am now becoming worried. Does anyone out there have experience in this area?

Hello, It depends mate how legit you want to be ! its always a risk some times nothing bad happens but again the money are not taxed ! so start from this point

You are misleading. Why you say the money is not taxed. It depends on the OP. My guess is they are.

OP arrange his own obligations ! At least in our case we have to arrange our own profits.

Didn't understand what you said. In any case, i am not in US but there are plenty affs from US. I think there was only one case of one affiliate having issues in the past, a decade ago, but in general there are no cases that i heard of of affiliates having legal issues.

Of course if you don't declare your earnings and such you are likely to have issues, but that's not related to gambling.

Thanks for getting back to me. Its been on my mind as my earnings have grown so much. It took me 3 years though to get to this point if anyone out there is aspiring to get some results. I have had to do this almost every other day however and it can get tiresome, but at least there is some kind of payoff. Obviously all of the money is coming in Bitcoin so I will have to pay taxes on it. Its strange how there is such little info online for us US casino and poker affiliates. I would have to say that this has to be the most profitable niche online that I have been involved in and that's after almost a decade of internet marketing experience under my belt. Anyways thanks guys, if you have any questions or want to keep this thread going you can message me.

I would say that your question is 10% gambling related and 90% accounting related so i would solve it that way - meaning go to some good accountant and understand how to work it out so you could enjoy your earnings and without worrying much.
And a good one. Someone who understands online/bitcoin part + savvy in terms of how to lower your taxes.

Some things you might want to consider.

- Add a terms & conditions section to your web site.
- Broaden your on-site marketing, so you don't look too focused on one locale.
- Geo-block visitors from your state, if you think their might be a conflict.
- Keep all marketing focused online, and no offline marketing where you are.

I personally think this is the best answer amongst all. Once you have all these put in place especially the terms and conditions, you can defend yourself :)

I appreciate all your feedback guys. Its been a rather strange road to get to this monthly amount. I'm looking forward to figuring out how to get to 50k a month and beyond. Kind of feel like anything is possible but its a daily and weekly grind mentally to keep pushing out content etc. Internet marketing is def starting to wear on me but its hard to stop when the money keeps growing. Anyways thanks again to everyone who responded to my question in this thread. Much appreciated!

There was a massive site (wont mention their name) but in the end took massive fixed fees and sold it off as advertising, that way they were not making a profit from players making bets, if you want to sell let me know haha

I'm considering possibly selling at the end of the year since we will likely be over 50k per month by than this is with only $1000 a month in expenses. It is pretty insane honestly since this is technically the beginning of my 4th year in this space. What's your offer?

It's not that strange really. There are not that many people promoting offshore gambling sites to US residents while simultaneously residing within the United States.

I presume the reason there is that people are scared of legal issues.

You can definitely have some issues there as it sounds that you don't have a solid legit setup.


You can promote as an affiliate in a couple of states like New Jersey and Pennsylvania (you can find all with some googling) if you have an affiliate license. There are two licenses: CPA and Revenue share. CPA is quite easy one-pager and Revenue share takes much more due diligence. For the application, you'll need to find a casino/sportsbook brand that is licensed in the state as they will actually submit the affiliate application for you. When you have the license, then you can promote brands that are licensed in the state. If you'll looking to sell, then I recommend hiring a local lawyer to go through everything so that you can have a legit exit.

I am not sure how is the US law, I do not target it. But from my point of view it´s very important to solve the legal things at first to have a quiet sleep and have nothing to worry about. Especially when you are growing like that, it´s not easy to fly under the radar as it is when you were small. Always better to be not so rich, but do the business as it should be and do not wake up in the night :)
