Finland Court Limits Tax Approach to Online Slot Winnings

Finland’s Supreme Administrative Court has rejected the tax authority’s game-by-game approach to taxing online slot winnings from outside the European Economic Area.
In a 3-2 ruling, the court determined that taxable income should instead be assessed by gaming session. This means losses from games within the same session may, in certain cases, be deducted from winnings. Losses from separate sessions, however, cannot be used to offset later profits.
The decision could also affect previous tax assessments, with some players potentially able to request adjustments for earlier years. Finland’s Tax Administration is now expected to update its guidance following the ruling.

This is a significant legal precedent for the Nordic market. Taxing players per individual winning spin without allowing loss deductions within the same session was an absurdly harsh tax model that heavily pushed players away from non-EEA operators.

In my opinion, switching to a session-based tax model is a much more realistic framework, though it still creates a gray area around how exactly a "single session" is defined and logged by operators. From an affiliate perspective, clearer and fairer tax rules for non-EEA casinos usually help stabilize player retention and overall LTV, as high-rollers won't be hit with unexpected tax bills on gross wins alone.
