Hi everyone.

I have received eleven DMCA strikes today and appealed all of them.
It appears that this is happening a lot and some (probably all of) of the accounts submitting the DMCA requests are fake accounts trying to delete/remove affiliate pages from search.

Senders names are redacted
URL is redacted
I have of course appealed all of them. Anyone else had these DMCA emails? Keen to know your thoughts and appeals.

It's not an easy fix. Probably legislation needs to be changed, which could take a while.

There isn't any financial incentive for them to fix it, and they'd rather serve you AI summaries than actual search results anyway because they get four times the engagement that way.

You need to hire a solicitor to tackle this sort of online activity. My policy is simple: if someone does something like this or deliberately runs smear campaigns against our company and brands, we take legal action. We’ve already won several cases and filed claims for damages. What’s more, some of them actually get in touch with us themselves to apologise, LOL.

They are anonymous most of the time and I have neither the money or resources to tackle such A'holes.
I'm a low but quality traffic one man band. With so much fraud, non payments, dodgy affs and now this, I may throw in the towel.
I really can't be doing with extra stress.

You need to hire a solicitor to tackle this sort of online activity. Sorry, I don't believe you. There's no way of even figuring out who these people are. Probably sit in Russia or similar, so good luck with that. Filing fake DMCA claims is punishable by law to begin with, I don't think they are worried about you or anyone else dragging them to court lol.

You don't have to believe, but you have to believe in evidence... just some extract from our latest legal team's work :) They know what to do, and they protect our portals globally.

Yes, correct, most of them come from Russia, Ukraine, Belarus, and Georgia, and most of them are also affiliates with busienss registsred in the UK, Cyprus, Malta, and some other jurisdictions in Europe. They are not so anonymous as you, just giving you a hint ;)

I mean, issuing a counter-notice is not very hard. That's not what I'm talking about. But taking "legal action", really? Who has time with that when you get 20 bogus DMCA bot strikes per day.

I dont know the whole process as I do not deal with it personally. Like I said, my legal department do all the hard job to combat this kinda activity and fight back.

Very hard to understand what your law suits are about without more detail but hundreds upon hundreds of big aff sites and operators are being attacked with these bogus DMCA claims and this is not something the industry can "law suit" their way out of. This is a completely different beast. This needs to be fixed from the source, which is how Google handles these false claims. The only law suit that will work will be the one made against Google.

We always investigate every case very thoroughly to find the bad actor. When you have a proper lawyer Google treat you like a partner, trust me :) Otherwise, you will get an auto-reply by robot.

If we're still talking about these bogus DMCA claims, I am getting these daily for a few months now and Google has not accepted a single one of them so far thankfully.

Google blindly trusts Lumen Register (https://lumendatabase.org/) just to protect their ass. That's why you a proper lawyer/solicitor to contact Lumen/Google/Brand owner at the same time and keep the conversation (case).

What I mean is, you will never be able to sue your way out of this by trying to go after the bogus claims because there are too many being filed every day. Some sites can get hundreds in a days. You cannot go after these actors by trying to sue each and every one of them. If it were that easy, this would have been solved already because you have high profile aff sites and operators being targeted too. They would have sued the hell out of these people already if it were possible.

The only law suit that will work is the one that will eventually be made against Google themselves.
