Definition - Commission

Commission: means the compensation due to the Affiliate based on the agreed percentage of Net ProfitRevenue generated by the New Depositor at Unibet.

Definition - New Depositer

New Depositor means a new customer having who: has created a new Unibet player account, registering immediately and directly after have been led by his last click/refer from the Affiliate Site or Advertising Space to one of Unibets websites, has made, in accordance with the existing terms and conditions, as varied from time to time, which it has accepted, a first minimum deposit with Unibet, and which deposit is used for bona fide transactions with an ultimate aim to establish and enter into a normal commercial relationship with Unibet within the framework of the Business, is not already in Unibets customer Database, even if the customer has previously closed his Unibet player account and opened a new one coming through the Affiliate. The above conditions are cumulative.

3.2 The tracking of a player is to his player account, not to the player himself. As a consequence, if a New Depositor creates a new player account by signing up to: a different brand within the Unibet group, or a new domain due to licensed market regulations, provided that Unibet was not authorised to migrate the players accounts to the new domain, the new player account will not necessarily be linked to the Affiliate.

Definition - New Depositer

5.2 Subject to the Affiliate complying with Unibets instructions with regard to tracking of New Depositors accessing the Unibet Site via the Links on the Affiliate Site, Unibet shall use its reasonable endeavours to ensure that whenever a New Depositor links to the Unibet Site through the Links on the Affiliate Site and they subsequently place a bet with Unibet, the relevant New Depositor is identified as originating from the Affiliate Site. However, Unibet shall not be liable to the Affiliate in any way if Unibet is unable to identify a New Depositor as originating from the Affiliate Site, neither in the situation described in clause 3.2.

6.2 The Affiliate shall be entitled to receive the Commission exclusively for New Depositors. The Affiliate shall be entitled to receive the Commission for each New Depositor for a lifetime value from the date of the first deposit made by the New Depositors, except in the event of a termination of the Agreement and in the situation described in clause 3.2.

Proof of Identity

6.7 In order to help fraud controls regarding affiliate accounts, Unibet reserves the possibility to: request at any moment a proof of the Affiliates identity, and/or valid place of residence, and/or bank details, retain any payment owed to the Affiliate until the requested documents have been provided by the Affiliate and Unibets verification has led to the conclusion of no existing fraud.

Affiliate Commissions - Invoices

6.10 Affiliate commissions that do not require VAT to be added are processed automatically through the NetRefer technical platform without the need for the Affiliate to raise an invoice. Payments shall be made approximately between the 10th and 15th in the following month calendar month. If the Affiliate is registered for VAT or wishes for VAT to be added to the monthly commission, it shall invoice Unibet before the 5th day of the month following the month for which the commission is to be paid. Failure to submit a valid invoice by this date will result in possible delay of payment to the following month. The invoice shall mention the PO number provided by their affiliate manager, be addressed to Unibet (London) Ltd, 4th Floor Wimbledon Bridge House, 1 Hartfield Road, London, SW19 3RU and the PO number provided by their affiliate manager and email the invoice to ULL_invoices@unibet.comj) .

Commissions and Fees

6.12 The Affiliate is responsible for making sure there are accurate to ensure the accuracy of the payment details in its Affiliate account and as such, any payment made to accounts listed in the Affiliate account will be considered as payment made by Unibet. Any cost incurred by Unibet owing to incorrect payment details provided by the Affiliate will result in those fees being passed onto be deducted from the commission due tothe Affiliate in the next monthly payment cycle in which there is a payment owing to the affiliate.

Fast Poker

6.15 Fast Poker: For the game Fast Poker, as an exception to the Commission Plan offered by Unibet on www. unibetaffiliate. com website, the Affiliates commission is capped at 15 % of the Net Revenue, unless a special promotion is offered by Unibet, or a special written agreement has been signed between the Affiliate and Unibet.

Market Closure

12. Term CLOSURE OF A MARKET The Agreement shall be considered as automatically terminated if Unibet has to re-enter a market with a different platform / URL extension, and Events cannot migrate its existing database of Default a) customers.

Fraud and Commissions

4.10 If Unibet determines, in its sole discretion, that the Affiliate has engaged in any of the foregoing activities, or Unibet detects any doubtful betting patterns, suggestive of any unlawful activity, or a breach of any obligation of the Affiliate under this Agreement - including, but not limited to, patterns that suggest that the referred player(s) in question is benefiting from money back or incentives from the Affiliate to compensate for their losses; and/or a consistently low number of referred players is active on the site; and/or 50% or in relation to Sportsbook or live casino, more of the total stakes in any monthly period is being bet on a single outcome by all referred players (such as arbitrage, including arbitrage in a team format where safe bet calculations have been given to players by their Affiliate) -, Unibet shall: have the right to suspend any payment due to the Affiliate while Unibet investigates any suspected breach, and/or have the right to alter the commission structure (notably by carrying negative revenue from a month to another), and/or have the right to withhold payment of any commission due to the Affiliate that has been derived from the purported breach, and/or have the right to retain on the Commission until the debt is settled or invoice the cost incurred by a breach to clause 4.9.13 by the Affiliate, and/or have the right to terminate the contract immediately, and/or pay to the Affiliate all money owed if the investigation made by Unibet leads to conclude that no breach of the Agreement has occurred. The bringing into play of one or several of the above measures will be without prejudice to any other rights, remedies, legal actions or compensations available for Unibet. When the alteration of the commission structure will be notified to the Affiliate, he will have the possibility to terminate the Agreement within 7 days. If the Affiliate does not terminate the Agreement, he will be deemed to have accepted the alteration of the commission structure. (j) If Unibet determines, in its sole discretion, that the Affiliate has engaged in any of the foregoing activities, or Unibet detects any doubtful betting patterns, suggestive of any unlawful activity or a breach of any obligations of the Affiliate under this agreement (including, but not limited to, patterns that suggest that the referred player(s) in question is benefiting from money back or incentives from the Affiliate to compensate for their losses; and/or a consistently low number of referred players is active on the site; and/or 50% or in relation to Sportsbook or live casino, more of the total stakes in any monthly period is being bet on a single outcome by all referred players (such as arbitrage, including arbitrage in a team format where safe bet calculations have been given to players by their Affiliate)), Unibet shall have the right to, terminate the contract immediately, and or to withhold payment of any commission due to the Affiliate that has been derived from the purported breach. Unibet may also, in such circumstances, and without prejudice to any other rights it has, alter the commission structure whereby any monthly commission will be calculated with reference to the Net Revenue earned over the previous month(s) i.e. negative Net Revenue in one month will be carried over to the next month and then used to calculate the Net Revenue for that month; if the Net Revenue for that month is also negative, both sets of negative NET Revenues will be carried over again to the following month. In such a case, Unibet will notify the Affiliate of the proposed change in the payment of the commission, whereupon, the Affiliate will have 7 days within which to cancel the Agreement. If the Affiliate has not cancelled the Agreement within this period, it shall be deemed to have accepted the revised payment structure. Furthermore should any fines be incurred due to the Affiliates lack of compliance with subsection 4. i) xiii., and without prejudice to any other rights or remedies available to Unibet, choose to pass any such fine onto the Affiliate either by deducting from future commissions until the debt is settled or bill the affiliate for each breach they had incurred. k) As an alternative to the options available to Unibet which are set out in clause 4 (j) of this above, Unibet may, as a result of the Affiliates actions indicative of a breach of this agreement, elect to suspend any payment due to the Affiliate while it investigates any suspected breach. If it chooses to suspend the account for this reason, it shall notify the Affiliate at the earliest opportunity, informing it that doubtful betting patterns have been detected and that the account has been suspended as a result. If the Affiliate wishes to terminate its account in such circumstances, it may do so at any time during the suspension period. Unibet shall investigate the suspected breach, and shall inform the Affiliate of the result of its investigation no later than beginning of the second once-monthly affiliate payment days. If Unibet finds sufficient evidence to suggest a breach of the agreement, it shall terminate the Agreement forthwith, and the Affiliate shall not be entitled to any monies currently owing to it as a result of the breach. If Unibet concludes that no breach of the Agreement has occurred with respect to the activity of the Affiliate or its customers, it shall pay the Affiliate all monies owed to it and shall calculate an amount of Net Revenue for the period of suspension based on a average of the Net Revenue generated by the Affiliate in the preceding 3 months (or if the Affiliate has not been registered for 3 months, for the number of months that it has been registered for). If the suspension takes place within the first month, the amount that has been generated up to the date of suspension will be extrapolated, to provide a figure payable to the Affiliate for the period of suspension of its account.


SUMMARY: If you are promoting Unibet properties, please stop. Read the terms fully - these changes are only to help Unibet, not their marketing partners.

Having already removed them from my sites, I then read all the terms changes above...
BIG MISTAKE! :mad:

It says the Negative Carry Over ONLY applies in cases of players (with or without affiliate compliance) hedge betting on sports for guaranteed profit.
Highly unlikely to happen IMO.
Also, where did you read the 3-months bit?

I can't see where it states that players will be un-tagged if deposit not immediate...?

Losing ALL players if Unibet migrated would be very serious, but they do state this would only happen if it was impossible to migrate (basically covering their ass for all eventualities).
Also highly unlikely to happen IMO.

To me, these terms changes don't look anything like as bad as Guard Dog made out - unless I'm missing something... ?

I highlighted some of the phrasing that leaves it open to interpretation. As far as the 3 months, I know it is in there somewhere but do not see it in the alert above.

What that clause is saying is that players will only be tagged if they click your affiliate link and join immediately. They must not go anywhere else in the meantime. It destroys the 30+ day cookie concept that all other firms abide by. ie: Player clicks an affiliate link and then comes back a few weeks later and he is tracked to you. With this new Unibet clause if he joins 10 minutes after clicking it he may not be tracked to you, for instance if he went and updated his facebook page inbetween. Whatever the merits of the other points you make, this clause alone surely destroys Unibet as a valid affiliate program.

OK, I have looked at their terms again and this is how it now reads:

“New Depositor” means a new customer who has created a new Unibet player account, registering directly after have been led by his last click/refer from the Affiliate Site or Advertising Space to one of Unibet’s websites: a customer will be tagged to the last affiliate who referred him to Unibet;

But this seems to conflict with the previous clause: a customer will be tagged to the last affiliate who referred him to Unibet

I am not sure this actually does mean "immediately" as they have removed the reference to "immediately". I can find any reference to cookies at all in the t&cs so can't see how long one would last. Plain English society required. They need to clarify how long someone is actually tracked for prior to joining up.

Change of subject: Why am I getting logged out of this forum every ten minutes? You'd get a lot more posts if you changed that setting. Don't ever have that problem on GPWA for example where you can stay logged in for hours. How many posts are written but then lost by being logged out by the time you come to post them?

Was set to 15 minutes (vBulletin default) - now set to 24 hours.

BTW: Excellent service you do. Vital for affiliates. Not sure you get the credit you deserve.

I remove now all the advertisements. It's a shame!!
