Maybe I misunderstood this - but I'm getting tired of having all these issues unresolved. Like many, I promoted Rival extensively (maybe too much) - so I'd love this stuff to go away.

I got this letter this morning from Ruby Royal and would like to know WHY you need docs verified for a LOSER - whom obviously lost after you accepted his money. Why can you accept the money without docs, but I cannot get my earnings?

Since your commission is below this amount we suggest that you move to any of the other payment methods for next month as we hope that by then your player has sent in his documents and we can therefore pay your commission. Update: Just wanted to update this thread - I have now been told I am getting paid via wire - THANKS!

Update: I don't know why the above was said, I've been told it was a mistake - the only reason I was not being paid was because of the $1500 threshold according to Ruby Royal. I'm glad they will pay me this month, but it doesn't address my concerns getting paid going forward. I have no problem with Ruby Royal, and on the few (400) clicks I sent them they got 2 players and made me money.

Finally I use eCheck - because Quicktender does not allow corporate accounts. I know that very few people are getting eChecks as most use QT, NT or MB, so... what is the reason for $1500 minimum to get a check? I mean besides the obvious of not having to pay the affiliate?

Gawd damn, that has to be without a doubt the most asinine excuse for not paying an affiliates commission that I have ever read!

Same thing happened to me two months back with Ruby Royal.
After countless inquiries as to why my affiliate payment was not processed I recieved a similar e-mail. Subsequently, I no loger promote Ruby Royal to the extent I once had. The amount of reputable Rival Operators is growing smaller by the day and no longer worth the exposure or the headaches.

They sure do because the best I can tell is that that condition was NOT in the terms and conditions that I signed up with Ruby Royal to promote as an affiliate!

See, this is exactly what I meant the other day when I asked 'Rival Rep' why they let the white labels get away with this sort of non-sense to just further damage the Rival Brand overall...don't think he/she responded to that though.

Andy, you should point him/her here to this thread for a comment from them and they can see first hand what kind of utter BS their marketing partners have to put up with from their affiliate programs...:mad:

Is this some sort of over late April Fool's joke? I mean really Ruby? This is beyond stupid and inexcusable. I was once called unprofessional by you for expressing my displeasure of the ridiculous things going down with Rival brands of course I never forgot that as you probably can tell by the lack of my effort in promoting your brands.:rolleyes:

Someone please show me that term in the affiliate agreement below, although Ruby Royal could have sunk it in there today since it says at the very bottom below, the T's & C's last updated Sep 15, 2010 11:13:31 PM CEST

What did they update Andy?

Terms and Conditions
The following are our complete terms and conditions to apply as a member of Ruby Royal Casino affiliate program. Please read this agreement completely.
By submitting the application form or linking to the Ruby Royal Online Casino - 888 free bets - US Online Casino site you are deemed to have agreed to be bound to the terms and conditions set out in this agreement.

You can enroll as a member of Ruby Royal Affiliate Program by creating a unique links to Ruby Royal using a simple text link or one of our banners located in our campaign manager once you log in to your account.

1. Definitions

1.1. "Site(s)", means the Ruby Royal Casino website located at Ruby Royal Online Casino - 888 free bets - US Online Casino and its related pages.
1.2. "Player(s)", means a person or entity that you direct in any manner to our site(s) and who can be linked to your affiliate ID and who opens an account with our site(s).By opening an account, that person or entity will become our site(s) customer and, accordingly, all rules, policies, and operating procedures will apply to them.
1.3. “Deposit” and “Deposits”, means funds transferred by players to their real money gaming account.
1.4 "Redeems", means any and all funds withdrawn or cashed-out by players from their user account plus amount pending on the players account plus any deposits reversed (or credits given) by us, in our sole discretion, to negate fraud, error, player non satisfaction or through charge-backs.
1.5. "Progressive Contributions", means a percentage of revenue generated on any progressive game that is paid over by the casino into a progressive pool.
1.6. “Affiliate ID”, means “Your ID” is defined as the unique number or string used to identify your affiliate account.
1.7. "Banners and Text Links", means the graphical artwork or text that will be directed to our sites home page at Ruby Royal Online Casino - 888 free bets - US Online Casino , through your tracking code(s), to permit a player to hyperlink from your website to our site.
1.8. “Tracking code”, means the tracking URL or other mechanism we provide exclusively, during the term of this agreement through which we track your traffic and calculate your earnings. All provided tracking codes will be unique to you.
1.7. “Adjusted Net Win and Earnings”:

Definition of Adjusted Net Win - Applied to affiliates that sign up BEFORE 23 December 2009
“ANW” and “Earnings” means the net revenue earned by an affiliate through Ruby Royal Casino affiliate program, based solely on our log files. The calculation for ANW is: ANW = Deposits - Redeems - Fraud and Chargebacks
Definition of Adjusted Net Win - Applied to affiliates that sign up AFTER 23 December 2009
“ANW” and “Earnings” means the net revenue earned by an affiliate through Ruby Royal Casino affiliate program, based solely on our log files. The calculation for ANW is: ANW = Bets - Wins - Bonuses/Comps/Free Credits - Fraud and Chargebacks

1.8. “Revenue Share”, is defined as the percentage of ANW payable to you at the end of each calendar month. The default revenue share rate is 28% of ANW generated by players referred by you.
1.9. "Sub-Affiliates" means all traffic generated via your dedicated links and generated by a 3rd party you contacted and linked to the site.
1.10. "Spam", means emails and messages that meet any of the following definitions:

A. An unsolicited mailing, usually, to many people.
B. Contain false or misleading statements.
C. Do not truthfully identify the source or the originating IP Address and / or the originating email address.
D. Do not contain an online and real time remove option.

As long as your visitor does not click on the link you do not send them any emails (note the verification of both the email address and random number). This avoids people filling in false addresses, which can later turn into spam complaints.

2. Our Rights and Obligations

2.1 Register your players
We will register your players and will track their play. We reserve the right to refuse customers (or to close their accounts) if necessary to comply with any requirements we may periodically establish.

2.2 Track players Play
We will track player\'s play and will provide you with remote online access to reports of customer activity and the advertising revenue generated.

2.3 Pay Advertising Revenue
We will pay you Advertising Revenue (defined above) we earn from players directed from your site after they open an account with us and based on deposits they make for real money.

2.4 Modification
We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on our site which we will notify you of. Modifications may include, for example, changes in the scope of available advertising revenue, fee schedules, and affiliation Program rules.

IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITE (WHICH WE WILL NOTIFY YOU OF) WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.

3. Your Rights and Obligations

3.1 Linking to rubyroyal.com and associated site(s)
By agreeing to participate in this affiliation Program, you agree to create a unique link from your site to Ruby Royal Online Casino - 888 free bets - US Online Casino and associated site(s) or domains. You may link to us with one or more of our banners or text links. These are the only methods by which you may advertise on our behalf. We will terminate this agreement immediately if there is any form of spamming or if you advertise our casino in any other unauthorized way. You shall not make any claims, representations, or warranties in connection with us and you shall have no authority to, and shall not, bind us to any obligations.

3.2 Agency Appointment
By this Agreement, we grant you the non-exclusive right to direct customers to our site and services, in accordance with the terms and conditions of this Agreement. This Agreement does not grant you an exclusive right or privilege to assist us in the provision of services arising from your referrals, and we obviously intend to contract with and obtain the assistance from others at any time to perform services of the same or similar nature as yours. You shall have no claims to Advertising Revenue or other compensation on business secured by or through persons or entities other than you.

3.3 Approved Layouts
Without our prior written approval, you will only use our approved banners and will not alter their appearance. The appearance and syntax of the hypertext transfer link are designed and designated by us and constitute the only authorized and permitted representation of our site. You may only use banners from the Ruby Royal affiliate campaign manager system.

3.4 Good Faith
You will not benefit from known or suspected traffic not generated in good faith whether or not it actually causes us damage. We reserve the right to retain all amounts due to you under this Agreement if we have reasonable cause to believe that such traffic has been caused with your knowledge. Even if you have not knowingly generated such traffic, we reserve the right to withhold Advertising Revenue with respect to such traffic.

3.5 Responsibility for Your Site
You will be solely responsible for ensuring that materials posted on your site are not libelous or otherwise illegal. We disclaim all liability for these matters. Further, you will indemnify and hold us harmless from all claims, damages, and expenses (including, without limitation, attorneys fees) relating to the development, operation, maintenance, and contents of your site.

3.6 License to use Marks
We hereby grant to you a non-exclusive, non-transferable license, during the term of this Agreement, to use Ruby Royal Casinos intellectual-property marks solely in connection with the display of the banners on your site. This license cannot be sub-licensed, assigned or otherwise transferred by you. Your right to use the marks is limited to and arises only out of this license to use the banners. You shall not assert the invalidity, unenforceability, or contest the ownership of the marks in any action or proceeding of whatever kind or nature, and shall not take any action that may prejudice our or our licensor\'s rights in the marks, render the same generic, or otherwise weaken their validity or diminish their associated goodwill.

4. Fees

Ruby Royal Affiliates calculates the commission payments at the end of each month and makes the payments. Unpaid commissions each month shall be carried forward and added to the next month’s payment.

We will pay you Advertising Revenue on the 15th day of each month, but not less than $100 (monthly or accumulated) on all payment methods, except Minimum Payment amount for Bank wires is $2,500 on all affiliate accounts. All payments will be due and paid in United States dollars.
Currently we do not pay commissions using USD wire transfer (alternative solutions are on offer, please contact affiliate support for further information).
If the account is in a negative position, the negative position will NOT be carried over into the following month(s).

Ruby Royal Affiliates WILL NOT enforce a "BIG WINNER or HIGH ROLLER policy. Should a high roller win a significant amount and play the money back into the casino, the affiliate deserves the right to earn back the revenue from this customer.

In the case of a progressive jackpot winner, in the event the winning player does not withdraw their winnings in full, the affiliate is not eligible to earn revenues should those winnings be played back into the casino. The affiliate therefore will also not cover any cost or deductions in commissions in relation to progressive jackpot contributions or play. Should the winnings be withdrawn by the player and then re-deposited back into the casino, the affiliate will be eligible to earn revenue from any losses.
The Affiliate is responsible for selecting the payment method when submitting their application to join the Ruby Royal affiliate program.
The Affiliate is responsible for providing Ruby Royal Affiliates with correct payment information details (i.e. online account details, mailing address, banking information etc).
Should Ruby Royal issue payment to the incorrect details used by the affiliate, Ruby Royal has the right in certain circumstances to deduct the fees charged for recovering the funds and re-issuing payment


Commission when player is an affiliate - Ruby Royal reserves the right not to pay an affiliate partner for their personal losses in the casino. This also includes relatives of the affiliate (i.e. Wife; Son; Daughter; In Laws: Aunt, Uncle) and friends in the case where geographic and demographic repetitive occurrences relative to the Affiliate that would allow the visible understanding and to ascertain a basis of collusion to constitute fraudulent activity to network, perpetrate, and to create "false" deposits to make them appear as "real" deposits in the Affiliate Program to receive the monetary gain in and from the "Ruby Royal" Affiliate Program.

Charge backs and Fraud costs are defined as credit card transactions that are reversed or dishonored or cancelled, as a result of the credit card having being used in a fraudulent manner or a dispute by the card holder which results in the transactions being reversed. Other payment or deposit reversals that arise out of non-credit card methods of purchase are included in this definition of charge-back and Fraud.

All charged back amounts and processing costs associated and resulting from such charge backs and Fraud will be deducted from your payment or the reserved funds that become owing to you. Should the player process a charge back, the disputed or charged-back revenue generated by yourself will be forfeited and therefore deducted from the total balance due to you for the current month. Should this deduction of the accumulated revenue exceed your current amount due, your balance will then revert to a negative balance, and you will have to earn revenue to cover the charge-back before you can start earning revenue again.

Sub Affiliates are totally obligated to these terms and conditions. We will make payments to you and your sub affiliates separately. We will not be held responsible for any dispute between you and your sub affiliates.

5. The term of this Agreement will commence when the Affiliate completes and submits the membership form and it is officially accepted by Ruby Royal Affiliates. Except as stated otherwise herein, the term will be ongoing unless and until either party sends written notification to the other that it wishes to terminate the Agreement. Upon receipt of written notification by either party, the Agreement will be considered to be terminated immediately. Termination is at will, for any reason, by either party. For purposes of notification of termination, email is considered a written and immediate form of notification.

5.1 Upon termination:
You must remove all of our banners/icons from your site and disable the link from your site to ours. All rights and licenses given to you in this Agreement shall immediately terminate.
If you have failed to fulfill your obligations and responsibilities, we may choose not to pay you the Advertising Revenue otherwise owing to you on termination.

We may withhold your final payment for a reasonable time to ensure that the correct amount is paid. If we continue to permit play from customers after termination, this will not constitute a continuation or renewal of this Agreement or a waiver of termination and you will not continue to earn revenue from these players.

5.2 Confidential Information
WE MAY TERMINATE THIS AGREEMENT IF WE DETERMINE (IN OUR SOLE DISCRETION) THAT YOUR SITE IS UNSUITABLE. Unsuitable sites include those that: are aimed at children, display child pornography or other illegal sexual acts, promote violence, promote discrimination based on race, religion, nationality, disability, or age, promote illegal activities, violate intellectual property rights.

5.3 Commercial Use Only.
This Marketing opportunity is for commercial use only, and you, your family members, friends, associates may not make Deposits, directly or indirectly, through your Tracker for your own personal use or to fraudulently increase the Advertising Revenue payables to you. Transactions made in violation of this provision will be deemed Fraud Traffic and we will deduct such earnings or traffic from your Advertising Revenue.

5.4 You shall defend, indemnify, and hold Ruby Royal Affiliates, their directors, officers, employees, and representatives harmless from and against any and all liabilities, losses, damages, and costs, including reasonable attorney’s fees, resulting from, arising out of, or in any way connected with:

Any breach by you of any warranty, representation, or agreement contained in this Agreement.
The performance of your duties and obligations under this Agreement.
Your negligence or any injury caused directly or indirectly by your negligent or intentional acts or omissions, or the unauthorized use of our banners and links or this Affiliation Program
We make no express or implied warranties or representations with respect to the Affiliation Program, Ruby Royal or marketing fee payment arrangements (including, without limitation, their functionality, warranties of fitness, merchantability, legality, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no representation that the operation of our site will be uninterrupted or error-free and will not be liable for the consequences of any interruptions or errors.

6. Relationship of Parties You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on Ruby Royal Casinos behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this paragraph.

7. Limitation of Liability. We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Affiliation Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total Advertising Revenue paid or payable to you under this Agreement during the last 3 months. Nothing in this Agreement shall be construed to provide any rights, remedies or benefits to any person or entity not a party to this Agreement. Any liability arising under this Agreement shall be satisfied solely from the marketing fee generated and is limited to direct damages.

8. Data Protection. You shall comply with any relevant data protection laws in the jurisdiction in which you are domiciled and any jurisdictions in which you operate. Customer data and ownership of customer is the exclusive ownership of the casino sites and managing parties.

9. Money Laundering. You may not directly or indirectly benefit from, or be a party to, any money laundering or related illegal activities.
It is recorded that some jurisdictions in which we operate have strict laws on money laundering that may impose an obligation upon us to report you to the federal or local authorities within such jurisdictions if we know, suspect or have reason to suspect that any transactions in which you are directly or indirectly involved, amongst other things, involve funds derived from illegal activities or are intended to conceal funds derived from illegal activities or involve the use of the Ruby Royal Affiliate Program or our casino sites to facilitate criminal activity.

If we have any knowledge or suspicion envisaged above we may (a) immediately suspend, deregister or terminate your membership of the Ruby Royal Affiliate Program; and/ or (b), in our absolute discretion, not pay you any funds due to You as Commission.

We reserve the right to report you to the aforementioned federal or local authorities should we, in our absolute discretion, determine that we are obliged, by law, to do so

10. Independent Investigation YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE OR CONTRACT WITH WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THIS AFFILIATION PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE, OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.

11. Miscellaneous
Governing Law. The laws of Curacao, Netherlands Antilles, without reference to will govern This Agreement rules governing choice of law. Any action relating to this Agreement must be brought in Curacao and you irrevocably consent to the jurisdiction of its courts.

Non-Waiver. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. None of our employees, officers or agents may verbally alter, modify or waive any provision of this Agreement.

Remedies. Our rights and remedies hereunder shall not be mutually exclusive, i.e., the exercise of one or more of the provisions of this Agreement shall not preclude the exercise of any other provision. You acknowledge, confirm, and agree that damages may be inadequate for a breach or a threatened breach of this Agreement and, in the event of a breach or threatened breach of any provision of this Agreement, the respective rights and obligations of the parties may be enforceable by specific performance, injunction, or other equitable remedy. Nothing contained in this Agreement shall limit or affect any of our rights at law, or otherwise, for a breach or threatened breach of any provision of this Agreement, it being the intent of this provision to make clear that our respective rights and obligations shall be enforceable in equity as well as at law or otherwise.

Waiver. Whenever possible, each provision of this Agreement shall be interpreted in such a manner as to be effective and valid under applicable law but, if any provision of this Agreement is held to be invalid, illegal or unenforceable in any respect, such provision will be ineffective only to the extent of such invalidity, or unenforceability, without invalidating the remainder of this Agreement or any provision hereof. No waiver will be implied from conduct or failure to enforce any rights and must be in writing to be effective. IN WITNESS WHEREOF, you expressly agree to the terms and conditions of this Agreement by downloading our banner and creating a link from your site to ours.

Devil's advocate. Maybe the player lost overall but still requested a withdrawal. There is a popular fraud exploit where players hit a casino and if they win, cash out and if they lose they charge back. This may be a case of ensuring docs are sent to eradicate the chargeback scenario before committing to payments.

The 'time' changed but the date didn't change...so are you saying that a 'new date' is listed there each day? So its not 'truly' a change in T's & C's? And the word 'Updated' does not really mean 'Updated'? ???

Its still not in the affiliate T's and C's though...Not that I can see anyway.

Also, if they 'lost overall' then what would they be requesting a withdrawal for?

The date will change tomorrow. It is still the 15th there. And, yes, Updated means nothing.

Well that's not of any use or any good, either way then. How the heck is any affiliate truly going to know when original terms were changed at a later date then, if they simply change the date each day on those terms saying "Updated".

That's about as ludicrous as not paying Bern there.

Yea, but that's not losing "overall" though...that's just losing a little compared to the deposit..;)

But yea, I can see now that that is maybe what Simmo meant.

I may be overlooking something simple, but if they take $1000 deposited on a credit card, QT or whatever, why would they need any additional documentation to return it to the same source?


(a) in the case they lost everything verification would not be necessary

(b) I do understand the charge-back concern - but in this case why wouldn't the player "play" out the full $1000 in order to try to win, then charge back if they lost? I thought that was the point?

(c) finally - I thought if they had a charge back that just showed up in my stats when it happened.

I just have never had this happen or had anyone say something like this before...

My guess is this was a cc deposit and they are holding on to your commissions because from what understand from a statement made by another ex white label owner is because Bonnie Chance is holding the casinos money for a certain amount of days to insure there is no chargeback. Complete BS of course but this is the only thing that makes since since as the mail reads the player lost in the casino.

Whatever the case you should have been given a better explanation.

Yes I interpreted overall to mean "in the end" or "after deciding not to play any more".

I've been plagued with chargebacks, Red Returns, C-Planet and a grand at Casino Coins.

Took a couple years to get out of the red at Red Returns, no pun intended.

While they're holding your commission hostage, aren't cb's are carried forward so subsequent deposits will be applied to the cb balance.

Unless of course that is your only player and he's banned or stops depositing and you pull the program.

I was under the impression that its up to 60 days to file a cb and beyond that it requires a bank managers approval, in the usa anyway.

The merchant needs to provide supporting documents when a cb occurs. Hence the request for documents.

Personally, I think we get wacked for the full enchilada when a player charges back and when the merchant wins never reimbursed.
