e-play24 add min activity clause

This has just been added to the e-play24 terms:

3.1.1 Continued Promotion
You shall incorporate and prominently and continually display the most up-to-date links and information provided by us on all pages of your website in a manner and location agreed by us and you shall not alter the form, location or operation of the links without our prior written consent. You are eligible for Referral Commissions based upon your continued promotion of www.casinoplex.com or www.pokerplex24.com.

We reserve the right to reduce Referral Commission percentages and/or not pay you the Commission Revenue earned, if you reduce your efforts to recruit new Customers and/or have removed all promotion material related to any of our sites:www.casinoplex.com or www.pokerplex24.com.

Your reduced or suspended promotion of our sites will be deemed to represent your termination of this Agreement.

Would it be fair to guess that this term applies retroactively do you think?

Looking into it. They moved locations of their terms and conditions, so updated and forcing new scan. Should have an alert within the hour.

** Edit. Have to re-construct as it is a very new set of terms since last scan. Unfortunately, looks like the old terms were left in place while a new set was elsewhere :( And the new ones were completely re-written. This it going to take more time than I thought.

Verified. New terms are completely re-written. That means a new evaluation is required. I will take them out of the certified section and place them elsewhere.

Yes, you are correct - that specific term stated has been in the terms since: February 2012.

I have left the e-play affiliates forum in predatory as this term is predatory towards affiliates.

Hi Martin,

Here's a change log for your terms and I can see where the confusion has arisen - http://www.changedetection.com/log/e-play24/agreement2_log.html#changelist

On the 3rd of June this year this term was changed from term 3.1.1 as you mentioned above to term 2.1. Then on the 13th of November the term was removed entirely. Then on the 23rd of November the term was added back in.

I'm not 100% sure of Andy's policies, but I think that this term is likely to be an issue.

I have the term in there consistently over our scans. But - yes, this term is predatory. So they are in the predatory section of AGD. That means it is not advisable for an affiliate to promote them.

Thanks and yes there was a few changes the last few days which may have caused the confusion. We strive to provide the most clear terms and conditions to our partners, but sometimes mistakes happens and therefore we have to add the missing parts, correct spelling mistakes etc. until the final version is complete. Once that was sorted informed our partners about the updates.
