Came across this gem yesterday...
This might be the most predatory ever?

“If at the conclusion of a calendar month the Commission generated by Money Players via the Site is a negative amount, the Company shall deduct such negative amount from the Commission calculation for the subsequent calendar months until such time as the negative balance has been fully set-off against future positive Commission amounts generated or any other payment payable to you by any entity in by the company. Alternatively we may require that you pay the negative balance and will issue an invoice for such negative amount.”

Caught this early, but it could have been a disaster for sure.

Not going to name names as they were not dishonest in any way, my fault really for not catching this!

A player wins at the casino, and then the casino may require that the affiliate pays back those winnings?

That is just ridiculous to include within the terms. They would have a difficult time collecting that from
an affiliate.. and in the process, most of their affiliates would likely abandon their affiliate program.

I do know which affiliate program that this is.

You, my Friend, are outrageous! You're going to post this and not tell other affiliates who the program is?? your just as bad as the program that has these crazy terms! they need to be called out. so start naming names.

Thanks to Skyla for bringing this up in the forum.

This really needs to be out in the open, because the affiliate program has added
a condition that is unlike any other.. and could negatively affect any affiliate here.

The affiliate program is Partner Up. It was certified at AGD last year. I don't know
how long that this affiliate program has had that as a part of their terms & conditions.

If you put the highlighted part of the terms & conditions into Google with quotes, it will
show the only result with that term.. and it points to the t&c for Partner Up Affiliates.
You will see the highlighted phrase at the end of the paragraph in section 8.3.

In relation to partner-up.biz, this clause is also an eye opener:

8.3 For the avoidance of doubt, we shall be under no obligation to pay any Commission with respect to Money Players who are at any time blocked or suspended by us for any reason (including for reasons of fraud or any failure to validate the end-user account). However, for the purposes of calculating the Gross Revenue, we may still deduct any or all charges or expenses attributable to blocked or suspended Money Players.

Using this as a search query in Google:
such time as the negative balance has been fully set-off against future positive Commission amounts

Reveals some downright crooked T&C (FU clauses) used by more than a couple of aff programs. Most is ambiguous, but still means the same thing.

I'm honestly a little taken back by this.

NCO isn't a new thing, but this makes NCO look like fairy-dust.

Doing a bit more digging... partner-up.biz (GOLDENCAERUS VENTURES LTD) their casino Gate777, is a White Label of White Hat Gaming. https://secure.gamblingcommission.gov.uk/PublicRegister/Search/Detail/52894

I've known Max Wright the owner of White Hat Gaming since 2006. I'm not sure he'd be too impressed with a licensee using such clauses to cheat affiliates. Given, it kind of brings the entire brand into question.

Just sent Max an email, I'll have a chat with him about this crooked clause.

These terms do not include this predatory term mentioned by Skyla

We will contact the Partner-up rep to to ensure the T&Cs are updated/link on FAQ page updated so all is uniform (without the predatory terms)

When I inquired about the term, this was the reply (since we are going there):
"As a company we see it as a cost we have to share together as it’s a revenue share deal, if there was to be a player generating for us 100K you would be keen to receive your 40K from them, so why should it be any difference in case of the players winning?
In our eyes and the way we see a partnership this is something we have to carry together."
