It appears Casino.com is now following the few programs who wish to deter affiliates from promoting their property. They have enacted a very predatory minimum player rule which requires 5 players prior to payment.

ADDED TERM, Predatory Term, Minimum Player Rule

5.12 A minimum of 5 First Time Depositors (FTDs) are required before a payment withdrawal request can be made by you.

Summary:This term is horrible for so many reasons. If an affiliate were to send their 1st – 4th players as high rollers, but Casino.com could not convert the rest of their players… The affiliate would not receive payment and Casino.com would profit incredibly. This is an active attempt to dissuade affiliates from sending traffic and is extremely counter-productive for a program to implement.

Title:Casino.com Terms Update – RakebackDate:October 15, 2008 5:37 pm

Casino.com have (along with many, many other affiliate programs) now banned rakeback affiliates from using this method of promotion.

NEW TERM, Promotion, Rakeback

9.1.13 You shall not offer any form of rake back, where all forms of Rake-Back are banned. ”Rake-Back” is a discount offered to players which is awarded through the player’s deposit account or in any other way, in accordance with a specified percentage of the rake and tournament entry fees that were generated by the player. You shall not offer any Rake-Back or so-called Rake-Back schemes whatsoever, or any similar schemes that offer or allow a portion of the players’ rake or tournament entry fees to be returned to the player in any form. You shall not advertise its site in, accept traffic from or otherwise be engaged with an offers of Rake-Back.

NEW TERM, Promotion, Rakeback

10.2 If you are in breach of the above Rake-Back prohibition as set out in section 9.1.13 above, then, without limiting, and in addition to, any other remedy that we may have under these terms and conditions and agreement with you, or applicable law, we may, in our discretion, send a warning notice to you. If you do not rectify any breach capable of repair within the time prescribed in our notice, then you will pay us a sum in compensation for the breach, which we may assess, at our sole and absolute discretion based on the type and scope of the breach and the damage caused in the amount of up to US$30,000. You acknowledge that any such compensation assessed by us will be our reasonable estimate of the damage likely to be caused to the network for the Operator’s breach. 10.3 In each event of breach or non-compliance, in addition to any other remedy that we may have under these terms and conditions or applicable law, including its right to compensation as described above, we shall also have the right, at any time, to seek damages from you for any new or continuing violation of any of the above provisions and to terminate your affiliate agreement with us.

Summary:Both new terms are there specifically to ensure that affiliates know they are not allowed to promote rakeback. This has been an increasing ‘profit drain’ for affiliates and affiliate programs alike and it is nice to see Casino.com take a stance.
