With very little nudging from the AGD Certification team, BetUS has removed their minimum player rule!

TERMS UPDATE, COMMISSIONS, MINIMUM PLAYER RULE

The net revenue plan (25-35% net revenue) commissionable earnings will be earned for the life of the customer, on all transactions contributing to the affiliates monthly NGR, for as long as the affiliate remains a member of this affiliate program and actively promotes BetUS according to the following :

You will be paid commissions for the lifetime of your player as long as you refer at least 5 legitimate depositing players during each 3 month rolling period . If any 3-month time period should lapse in which you do not refer at least 5 players , you will forfeit the right to any future commissions on players referred previously and your affiliate account will be closed . Your affiliate manager is always available to help you develop a plan for success , and exceptions can be made at the manager’s discretion.


Summary: Great work BetUS! This is what we were waiting on to list your program as affiliate-friendly!

From the terms and conditions, it would appear that Neteller is no longer a payment option for affiliates. That would really surprise me, though, but please check with your affiliate manager.

BetUS have also updated their SPAM terms. This is a great move which will help them gain a better reputation in the long run.

We do not tolerate spamming of any kind by our affiliate partners. If spamming by an affiliate is brought to our attention we will give the affiliate one warning (if judged to be a minor case). After one warning and rules on spamming has been given to the affiliate, if the activity is not ceased he/she will be permanently banned from the program. Under no circumstances may an affiliate send email blasts including a direct link back to any page on BetUS.com using a direct reference to the brand (i.e. www.betus.com/ats/123456/) as this is considered brand infringement (see TCs). The only links permitted are those using the new encrypted token provided on the BetUS Partners site. (i.e. record.partners.betus.com/12345648679). For more details refer to Legal Responsibility, #8.


Summary:Again – it is great to see both Terms and FAQ updated to show that spammers are not tolerated.

BetUS have updated their FAQ, appropriately, with rules against spamming. This is great news and all programs should adopt this level of spam-laws.

BetUS has a brand new affiliate website. With that website comes a few changes to the existing terms and conditions. All changes are outlined below.

TERMS UPDATE, Referrals, Self-Referral

9. Self Referral: Affiliates are permitted to establish player accounts a player account with our client properties BetUS and wager real money on any game offered. However, BetUS policy prohibits affiliates from registering these accounts with the their player account under their own affiliate sheet.


Commissions will be not paid out for their activity and the player account will be removed from their affiliate sheet. In this manner, affiliates are restricted from earning commission from their own wagering.


Not only will there not be any commissions paid out to affiliates for such activity but said player account will be removed from your affiliate sheet. In this manner, affiliates are restricted from earning commission revenue from their own wagering.


TERMS UPDATE, Referrals, Sub-Affiliates

To receive credit for Sub-Affiliates, you must register them through the BetUS Partners Site or through your Affiliate Manager. In order to be clear, YOU WILL ONLY RECEIVE CREDIT FOR SUB-AFFILIATES THAT YOU SPECIFICALLY REGISTER UNDER YOUR SHEET. Any person registered as an Affiliate cannot subsequently be reclassified as a Sub-Affiliate. Under no circumstances are you allowed to (i) register yourself as your own Sub-Affiliate; (ii) use fictitious or alias names for the registration of Sub-Affiliates; or (iii) offer any type of enticement of monetary value or otherwise to potential Sub-Affiliates unless such enticements are approved by us.


Sub-Affiliates will be reviewed and accepted or rejected at the discretion of the Affiliate Program Management.


In addition to the Affiliate Fee for Players you refer; you will also receive, subject to the agreed upon payment plan and rate, 5% off of your Sub-Affiliate’s commissions. This amount will be cumulative if minimum for payment would not be met by end of month.

Sub-affiliate commission will not be subject to negative carryover. If minimums are reached, it will still be paid even when regular Affiliate commissions don’t reach the minimum.


TERMS UPDATE, Commissions, FEES

BetUS and other sister brands may include processing and/or networking fees in commission calculations depending on the platform and payment method.

Negative earnings are not carried forward to the next month in the Sportsbook, Casino and Racebook. This does not apply to our poker channel. Should the affiliate close the month with a positive balance (profit), payment will be issued to the method selected if it meets the minimum requirements and commissions will be paid on the positive balance threshold.

Affiliates are paid commissions once per month and we process the payment on the 15th of the following month. We send commission statements around the 15th of the following month and continue to process payments until the end of that month. Payments are expected for delivery approximately 2 weeks after processing is completed. Payments are effected by Neteller, Check, Debit Card, Moneybookers, Bank Wire and into a Sportsbook or Poker account. It is the responsibility of the affiliate to select the method of payment. Unless otherwise stipulated all payments will be made by Check.


TERMS UPDATE, Marketing, Trade Name usage

Affiliates are restricted from incorporating the “BetUS” trade name or any variation there of in any social networking site (Facebook, MySpace, Friendster, LinkedIn and Twitter). This includes profile name, display name or social networking domain.


TERMS UPDATE, Modifications, Terms Modifications

NO MODIFICATIONS, ADDITIONS, DELETIONS OR INTERLINEATIONS OF THIS AGREEMENT ARE PERMITTED OR WILL BE RECOGNIZED BY US. None of our employees, officers or agents may verbally alter, modify or waive any provision of this Agreement.


TERMS UPDATE, Terminations, Rights and Final Payment

Term Termination The term of this Agreement will begin when you download linking code and link it to our site register as an affiliate by completing the online form. The relationship between merchant and affiliate will be continuous unless and until either party notifies the other in writing that it wishes to terminate the Agreement, in which case this Agreement may be terminated immediately. TERMINATION IS AT WILL, FOR ANY REASON, BY EITHER PARTY.


We may withhold your final payment for a reasonable time to ensure that the correct amount is paid. If you have failed fail to fulfill your obligations and responsibilities, we will not pay you the referral fees otherwise owing to you on termination We may withhold your final payment for a reasonable time to ensure that the correct amount is paid.


Summary:There is nothing special about most the modifications as they say the exact same thing with different wording :) However – the 2 that are shown as ‘warning’ are different. For example: What are ‘networking fees’ which will now be deducted from affiliate payout? And now their employees can change the contract, according to the document (but not according to law), now that they have changed it already :) Interesting terms draft.

It appears that Moneygram is no longer a payment option at BetUS, according to their updated FAQ Page. As of 6/12/2009, this portion of the terms was removed.

UPDATED TERM, Commissions, Payment Method

4. Is there a minimum balance required to receive a payout? Yes, the minimum balance required is: NETeller $25 minimum Moneybookers – $25 minimum Check by courier – $200 Bank Wire – $500

Summary:This is a simple removal of payment method and seems to happen quite frequently all over the place. I doubt Moneygram is used by very many affiliates, but those who use it will now need to find an alternate payment method from BetUS.

BetUS adds a SEM Policy to their terms and conditions which strictly forbids usage of their brand name in PPC and URLs. In addition to this, they are outlawing the usage of site scrapers to access their own information for usage on an affiliate website.

NEW TERM, Marketing, SEM Policy


Search Engine Marketing Policy (SEM) Policy – Affiliates engaging in Search Engine Marketing to include Search Engine Optimization (SEO) and /or pay per click advertising (PPC) to promote www.BetUS.com are not authorized to utilize or bid on keywords incorporating the ?BetUS? trade name (A.K.A. branded terms) or any variation there of. In addition domain names can not contain any variation of the words BetUS at any time, nor can the site resemble www.BetUS.com. Any offences by an affiliate or advertiser doing so will result in their account closure and forfeit of all players. Affiliates are not allowed to use any outside technology to access, crawl, acquire, copy, ”deep-link,” ?inline-link? or ”page-scrape.” This includes the use of ”robots,” ”spiders” or other automated devices, programs, algorithms, methodologies or monitor any portion of the BetUS.com web site. Affiliates caught using outside technologies to compromise www.BetUS.com infrastructure and resources will be terminated from the program.


Summary:BetUS is protecting their reputation as well as their brand by adding the term above to their current T&C’s. Sports-related sites are often scraped for latest updates to betting lines as well as other unique and constantly changing information. This term will protect BetUS from affiliates hoping to scrape and use their information.

It appears that BetUS has removed ACH as a payment option for affiliates.

TERM UPDATED

Payments are effected by Neteller, Check, ACH, Bank Wire and into affiliate’s a sportsbook or poker account.

Summary: You can see, from the updated Terms and Conditions, that ACH has been removed as an option for affiliate payments.  Some wordsmithing was also completed to show that BetUS WILL transfer funds into a casino account (sportsbook or poker).
