"Payment Service Provider" means a 3rd party with whom we have an arrangement to process money transfers. AND . Upon confirmation of money transfer from us to the Payment Service Provider, we shall not be liable for any damages, loss or cost suffered or incurred by an Affiliate (including any damages, loss or costs suffered or incurred as a result of a failure to pay or delay in payment).


Summary: Unsure why this term has been reversed, but these things do happen by accident (i.e., Old Terms re-uploaded to site, accidentally).

This terms update is in regard to charges and losses by the payment processor employed by Referback.

Definition - Payment Service Provider
"Payment Service Provider" means a 3rd party with whom we have an arrangement to process money transfers.


Commissions - Payment Losses
Payment shall be made by ReferBack to the Affiliate by way of the method selected by the Affiliate on registration, but only in US Dollars. Upon confirmation of money transfer from us to the Payment Service Provider, we shall not be liable for any damages, loss or cost suffered or incurred by an Affiliate (including any damages, loss or costs suffered or incurred as a result of a failure to pay or delay in payment).


Summary: Referback is absolving themselves from any losses incurred by processing of affiliate payments.

Referbacks have updated their terms to exclude promotion to French Territories.

TERMS UPDATE – TERRITORY RESTRICTION

Unsuitable sites are, inter alia, but not limited to, those sites that are aimed at children, promote violence, promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age, promote illegal activities, or violate intellectual property rights, or actively seek to target residents of France , or are otherwise considered by ReferBack to bring ReferBack or its Merchants into disrepute or prejudice the interests of ReferBack or its Merchants in any way.


Summary: This is a simple update to the terms which ensure that affiliates can not promote to French Territories.

Referback have changed their terms and conditions such that the EGBA code of conduct now must be adhered to in order to remain an affiliate for their casino properties:

TERM ADDED

2.3. By applying to be registered as an Affiliate of the Affiliate Program, the Affiliate warrants that all of their marketing activities adhere to the EGBA code of conduct.

Summary: Referback, along with several affiliate programs, are adhering to the EGBA code of conduct for advertising practices.  This is a great thing for affiliates and the industry!

Referback has added a new clause to their ‘Terms of Use’.  This clause uses the EGBA (European Gaming and Betting Association) guidelines as a basis for all affiliate marketing practices.  To view the EBGA guidelines, see: http://www.egba.eu/en/about/conduct

SUMMARY: The EGBA states that webmasters must not use either misleading or false advertising, should not solicit or target minors, and should not engage in spamming activities.  This term is ok so long as Referback monitors all changes to the EGBA guidelines themselves to ensure they do not infringe upon the rights of webmasters in the development of their own content.
