AffClub have changed the terms regarding Minimum Payment as well as a change to the URLs which are available for promotion.

TERMS UPDATE, COMMISSIONS, MINIMUM PAYMENT

2.12 ”Minimum Required Deposit” means the minimum amount required to open a Player Account as indicated on the Site, (currently set at US$10) . Such deposits must then add up to a cumulative deposit for each player in order to satisfy US$50 where you choose the qualifying criteria ( currently set at US$50) Per Sign Up Plan and US$10 where you choose the Percentage Plan). Notwithstanding any other provisions contained elsewhere in this Agreement, we reserve the right to alter the amounts mentioned within this Clause 2.12 at any time by virtue of placing notice on the Site.

2.14 ”Our Marks” means the words ”ENTERCASINO”, ”NOBLEPOKER”, ”CLUBDICECASINO”, ”CARNIVALCASINO”, ”50STARSCASINO”, NOBLECASINO, ‘ ‘FAIRPOKER”, ‘‘CASINOKING”, ”MAGICBOXCASINO”, ”CASINOLASVEGAS”, ” CASINOSWISS”,‘MISSBINGO”, ‘CASINOSWISS”, ”SCASINO” and/or any logo, mark, domain name or trade name that contains, is confusingly similar to or is comprised of Our Marks or any other name or mark owned from time to time by us or any company within the Group.


Summary:The minimum payment rule is really the same, but is re-written to sound a little more clear. FairPoker and MissBingo seem to now be excluded from promotion at AffClub. Fairpoker.com now redirects to Noble Poker and MissBingo.com redirects to PartyBingo.com

AffClub have changed their terms to include automatic termination for accounts that do not bring them enough money.

TERMS UPDATE, TERMINATION, INACTIVE AFFILIATE

5.5 Automatic Termination By Us If Your Account Is Inactive . If your Affiliate Cashier Account is inactive , your Agreement and participation in the Affiliate Network will automatically terminate . In this Section , ‘ ‘Inactive” means where ( i) you have not generated sufficient Affiliate Accruals to trigger a payment into your Affiliate Cashier Account or you have not cashed out any funds ( through a withdrawal or a transfer to a Players Account ) for one hundred and eighty three ( 183) days or more ; or ( ii) you have failed to respond to any verification mails sent to you within a reasonable time . Where automatic termination occurs , any funds remaining within your Affiliate Cashier Account will revert to us .


TERMS UPDATE, COMMISSIONS

4.4 Minimum Payment and Time of Payment. All Affiliate Accruals generated through your chosen Payment Plan will be paid into your Affiliate Cashier Account within fifteen (15) days of the close of each calendar month. We may impose reasonable restrictions on the frequency and amounts that can be cashed out of your Affiliate Cashier Account for administrative convenience and/or to protect the security of your account. At our sole discretion, we may in impose a policy that if the amount due is negative or less than USD10 in any particular month, then that ( i) any negative amount will carry over and will be deducted against the following month , and ( ii) any amount less than USD10 will carry over and become payable in the calendar month in which the total amount of Affiliate Accruals exceeds USD10 in accordance with this clause.

3.2.17 Attempt to market or promote our Services (or any specified part thereof) or Sites (or specific Site) within territories which are Restricted Territories; to attempt to circumvent any restriction which we have put in place to prevent players from restricted territories from signing up as Real Money Players; or attempt to disguise to geographical location of a Player . If we determine , in our sole discretion , that you have engaged in any of the foregoing activities , we may ( without limiting any other rights or remedies available to us ) withhold any Affiliate Accruals and/or terminate this Agreement immediately on notice.


TERMS UPDATE, MARKETING, COMPETITIVE MARKETING

3.4 Competitive Marketing. You shall not market the Site and/or us or our Services or Our Marks in any way whatsoever, unless such activities are approved in writing by us (i) on any website on which we promote any of the Sites; and (ii) on or through any Internet search engine on or through which we promote any of the Sites and ( iii) in any other manner that results in you competing with us in relation to the promotion of any of the Sites or (iii) iv) otherwise where we request that you cease the same.


TERMS UPDATE, BONUS CODES

2.21 A ”Sign-up Bonus Code” is a unique alphanumeric code that we may make available to you to provide to prospective Players. When entered, the system automatically logs the Sign-up Bonus Codes and records you as the Affiliate in relation to the relevant Player . Further , Sign-up Bonus Codes may automatically be entered/logged by our system with some CDs that we may provide to you and that may be used for installation of our software by any prospective Player.


Summary: These are a group of terms which force AffClub into Rogue status. Considering there is no ‘effective date’, it is assumed that these terms are applied with immediate affect as of January 6, 2010.

UPDATED TERMS, Company, Information Change

Where used in this Agreement, references to: (i) ”you”, ”your” and/or ”Affiliate” mean the individual or entity that applied as the ”BENEFICIARY” for payment purposes on our sign-up form as submitted at our website (”Affiliate Sign-up Form”) (ii) ”we”, ”our”, ”us” means AffClub PartyPartners Limited, a company registered in Gibraltar with company number 93729 and whose registered office is Suite 7, 711 Europort, Gibraltar and the Group as defined in Section 2.9


Summary:It is difficult to tell from the new language if there is ‘no negative carryover’ except in special situations…. or if it is just stricter language. It is interesting to note, however, the name PartyPartners now appears in their copy.

AffClub Affiliates have made changes to their Terms and Conditions, adds a ‘Whistleblowing’ page to their website, and appears to purposely get the date wrong on their T&C’s change date.

Legal Agreements The Purpose of this Agreement is to regulate our relationship with you and to protect us in the event of any purposeful and deliberate misbehaviour by our Affiliates.

UPDATED TERM
Legal Agreements The Purpose of this Agreement is to clarify the nature of your relationship with us. This Agreement in the most part deals with defining the operating terms of the relationship. It also refers to some Breach Disciplinary Clauses. These clauses are intended to only be exercised on those rare occasions where some inappropriate behaviour has been committed and an affiliate is in breach of the Agreement. Our intention is to create a successful and long-term relationship with our Affiliates and to ensure you are rewarded well for your efforts. Provided you act in good faith there should be no need for us to exercise any of the disciplinary provisions contained herein. Any changes to this Agreement will be communicated to you in accordance with Clause 1.3 of the Agreement below. Changes to the Agreement are generally made in line with regulatory developments or if the nature of the industry landscape changes. The Purpose of this Agreement is to regulate our relationship with you and to protect us in the event of any purposeful and deliberate misbehaviour by our Affiliates.

Summary: This change appears simple enough. It is a bit strange that it is necessary, but a good addition nonetheless.

Summary: It appears that 50StarsCasino.com was neglected in the previous terms :) It is now added to the available sites for promotion.

Summary: This type of practice is predatory, IMO.  This leads affiliates to believe that the last update of the terms was December 4th 2007 when it was, in fact, updated on June 2nd, 2008.  This is a horrible practice and needs to be stopped, IMO.

AffClub has changed their FAQ and Commissions pages on their website in order to remove Noble Poker from CPA affiliates. It appears that anyone on the CPA commissions model can no longer promote Noble Poker. Since Affclub did NOT notify their affiliates, nobody is 100% sure of why this change was made.

This is a very strange change and should have been something they notified their affilaites about :(
