SBOBet Affiliates make changes to terms in regards to fraud and affiliate payments.

Definition - Data Protection Law
"Applicable Data Protection Law" all legislation and regulations relating to the protection of Personal Data including (without limitation) the Isle of Man Data Protection Act 2002, the UK Data Protection Act 1998, the UK Privacy and Electronic Isle of Man Unsolicited Communications (EC Directive) Regulations 2003Regulation 2005, the UK EU Data Protection Directive, the UK Regulation of Investigatory Powers Act 2000Directives, the UK Data Protection (Processing Council of Sensitive Personal Data) Order 2000 Europe Convention 108 and all other industry guidelines (whether statutory or non-statutory) or Codes of Practice issued by the Isle of Man Data Protection Supervisor or the UK Information Commissioner relating to the processing of Personal Data or privacy or any amendments and re-enactments thereof;


Fraud
6.2 In the event a Player is found or suspected to have cheated, or defrauded SBOBET or any other user of the Internet Betting Facilities or had attempted to do so in any way, including but not limited to bet or betting manipulation, abusing of bonus or rewards promotions, payment fraud (including use of stolen credit / debit cards, chargeback or other reversal of a payment or money laundering). SBOBET reserves the right to move that Player over to a non-commission plan under the Affiliate Account.


Commissions
6.6 6.7 Payment of the Commissions Monthly Commission shall be made in accordance with the payment method chosen by the Affiliate in the Affiliate application process. If an error is made in calculating the Monthly Commission payable to the Affiliate, then Celton Marketing reserves the right to correct such calculation at any time and will pay out underpayment or reclaim overpayment made to the Affiliate by way of a deduction or set off against any future payments payable to the Affiliate. 6.7 Payment of the Monthly Commission shall only be made in the name of the Affiliate. Payment to parties authorised by the Affiliate shall be subject to Celton Marketing prior approving such party and the Affiliate providing Celton Marketing with a validly executed written authorisation in the form agreeable to Celton Marketing, to make payment of the Monthly Commission to the authorised party.

Commissions Payment
In the event that payment is to be made to an authorised party pursuant to Clause 6.7, the Self Billing Invoice shall only be raised in the month following the calendar month that the Affiliate complies with all of Celton Marketing's requirements for making payment to authorised parties.


Strange Term
6.19 6.20 Celton Marketing may at any time or times, without notice to the Affiliate set off (legal and/or equitable set-off) any liability, debt and/or financial obligation/outstandings of the Affiliate to the Betting Platform Provider or Celton Marketing, including but not limited to any Commission that is of a negative amount under any commission plans offered by the Betting Platform Provider or Celton Marketing against any liability of the Betting Platform Provider or Celton Marketing to the Affiliate, whether any such liability is present or future, liquidated or unliquidated, due or payable under this Affiliate Agreement or not and irrespective of the currency of its denomination. If the liabilities to be set off are expressed in different currencies, the Betting Platform Provider may convert either liability at a market rate of exchange for the purpose of set-off. Any exercise by the Betting Platform Provider or Celton Marketing of its rights under this clause shall be without prejudice to any other rights or remedies available to it hereunder or otherwise.


Summary: The terms changes by SBO are not horrible changes overall, but do not forget that their terms ARE horrible for affiliates with such terms as: 6.18 After the initial 120 days of registering the Affiliate Account and the Affiliate selecting the Revenue Share Commission Plan, the Affiliate must have a minimum of 5 active wagering Players within a billable calendar month to be eligible for a Commission payment. Betsson / Affiliate Lounge are closing affiliate accounts with MANY, MANY players. They are stealing commissions for GOOD affiliates. This operation has PROVEN ROGUE STATUS over years of predatory behavior. It may be time to band together for a lawsuit or at least block their progress into regulated markets.

7.9 Minimum Activity
We are writing to notify you that your account has been inactive for the past 6 months (has not generated a minimum level of activity / new depositing players). Under rule 7.9 of our terms and conditions the Company reserves the right to set limits for a minimum level of activity on Affiliate’s accounts and to terminate any agreement not reaching the limit. Consequently our Affiliate Agreement is now being terminated. Your March and remaining unpaid commission will be paid out in early April 2014 and your account will be permanently shut down after this process. You will not be eligible to earn or receive Commissions after the effective termination date.

Betfair adds Bingo to structure. Also removes commissions for all players you have sent after 60 months (5 years).

Definitions
''Net Bingo Winnings'' means total winnings from Customers (stakes received less winnings paid out) made by the bingo product accessible via the www.bingo.betfair.com website less any payments to third party software providers, the cost of any promotional offers (including any sign up bonuses), adjustments made for any credit card charge-backs or any other reversal of a payment, fraudulent or otherwise voided or modified transactions, bad debt, and liability to any betting duty or licensing fees for data or other duty, tax or expense that may arise; ''Net


Agreement
Agreement. 2.2 It is a condition of this Agreement that you will not do any of the following: (a) display the Links other than on the Internet Site; (b) display the Code in any offline media without Betfairs prior written approval; (c) display data from the Links via any electronically accessible medium other than the Internet Site without the express written consent of Betfair; (d) do anything that would cause Betfair to believe that a Customer has clicked through the Links to register for an account when that is not the case, sometimes known as cookie stuffing and/or(e) (e) use the Links or Code in a way which proves or is likely to prove detrimental to Betfair; and/or (f) use the Links or Code in any pop-up or pop-under advertising without the prior written consent of Betfair. 3.


Commissions
4.3 Subject to these terms, if you select a Revenue Share Betfair shall pay you in respect of each Customer: (a) the agreed percentage of Net Exchange Commission and Net Multiples Winnings for a period of 60 months from the date of first registration if such Customer is introduced on or after 1 December 2013; (b) the agreed percentage of Net Exchange Commission and Net Multiples Winnings for a period of 36 months from the date of first registration if such Customer is introduced on or after 1 August 2011;(b) 2011 but before 1 December 2013; (c) the agreed percentage of Net Exchange Commission and Net Multiples Winnings for a period of 12 months from the date of first registration if such Customer is introduced before 1 August 2011; (c) d) the agreed percentage of Net Fixed Odds Winnings for as long as a Customer has an account with Betfair or a Group Company if such Customer is introduced on or after 1/11/12; and (d) e) the agreed percentages of Net Arcade Winnings, Net Bingo Winnings, Net Games Commission, Net Poker Rake and Net Casino Winnings for as long as a Customer has an account with Betfair or a Group


Summary: For people with a true long term business, the 60 month term can be a problem. It seems you would be better off sending your traffic to places with lifetime earnings instead.

Simple change which appears to remove Neteller and Affiliate Speedpay (which is gone anyway) from terms and conditions.

Summary: It appears that Neteller and ASP (gone anyway) are no longer options for payment at Commission Account.

In some cases (maybe all?), Ellmount Gaming will not pay US affiliates. The only options in the backend are: Skrill and Operator account. The problem is that US affiliates cannot have either.

Commissions Payments
15.2 Method of Payment All payments will be due and payable in United States Dollars only. Payment will be made into an Operator Account (Player Account at www.casinoroom.com) only or any other method as SITES in their sole discretion decide, however, SITES will try to accommodate the Affiliate's preferred payment method. Any charges, if any, for payments will be covered by the Affiliate and deducted from the Balance. We are unable to pay to any US bank accounts or US Skrill accounts.


Summary: If you are a US affiliate, please contact Ellmount Gaming immediately to find out if they can/will pay you. Let AGD know if you are able to be paid.

Winner Affiliates are not new to making changes that improve their pocketbooks. These set of changes (especially revshare) are a good reason to re-evaluate and stop partnering with this group.

Definitions
"Casino Net Gaming means the amount of Casino bets minus Casino winnings minus Casino bonuses, Chargebacks or any other revenue returns, credits, compensations or refunds given to Players, plus adjustments for Casino bonuses.

"Poker Side Games" - means the amount of Poker Side Games bets minus Poker Side Games winnings minus Poker Side Games bonuses,Chargebacks or any other revenue returns, credits, compensations or refunds given to Players, plus adjustments for Casino bonuses.

Sportsbook'' means the Operator's online sports betting product. Sportsbook Net Gaming'' means the amount of Sports bets minus Sports winnings minus Sports bonuses, Chargebacks or any other revenue returns, credits, compensations or refunds given to Players, plus adjustments to Sports bonuses, plus adjustments to Sports bonuses.

"Revenue Commission is the percentage of Casino Net Gaming, Games Net Gaming, Poker Net Gaming, Poker Gross Revenue, Bingo Net Gaming or Sportsbook Net Gaming payable to you if you choose the Revenue Share payment plan. We shall be entitled to set off any costs related to the processing service provider, any third party license fee, royalties or any other applicable payments to third parties as well as any tax, charge, levy, tariff or any other similar mandatory payments levied or charged on gaming turnover.


Player Data
Players' Data It is clarified that any and all data relating to the Players shall be and remain our exclusive property and that you will not have any right to use such data for any purpose whatsoever without our prior written consent, which may be withheld at our sole discretion.


Confidential Information
You shall keep all such Confidential Information in strict confidence and not use any part of it, directly or indirectly, for any purpose other than the purpose of this Agreement. Confidential Information shall not include any information that is generally known or available to the public (provided that the relevant information was not made known to the public by you or any third party breaching a confidentiality obligation),


Negative Carryover
Negative Balance Carry-Over (NCO) A negative balance in your affiliate account with us is relevant only to the Casino Revenue Share payment plan, and means that the total of all bets generated on your Trackers is less than the total of all winnings plus bonuses generated on your Trackers (i.e., your Casino Net Revenue is negative).

WINNER has a negative carry-over policy, meaning that from the third month of this Agreement (after a two-month grace period, any negative balance in your affiliate account will be carried over to subsequent months and will be set-off against the payments due to you in the subsequent months, until the full negative balance is thus set-off. In order be qualified to the "grace period", affiliate must have a minimum of 20 qualifying Players on a monthly basis during the grace period unless an alternative NNCO policy has been specifically agreed with an affiliate account manager in advance.


Terms Transfer
No Assignment You may not assign or transfer this Agreement or any part thereof without our prior written consent. We may freely assign or transfer this Agreement or any part thereof without your prior written consent.


Commissions Revshare
The following is an image created to explain the revshare changes. The games section is new, the 12.5% revshare level is new. The rest of the red shows what was previously in the terms:


Summary: The addition of a 12.5% revshare is predatory. Their website states 25% - 45% revshare which is false and very misleading. This group is not worth your time.

ChipSplit removed 'termination' from the marketing materials clause. This is a definite improvement upon the term.

Affiliates will comply with all reasonable instruction made by our company to maintain and update brand related content, marketing materials and promotional offers made available to them by ChipSplit on behalf of our branded partners (CarbonSports, CarbonPoker and Aced Poker). Should we contact you in regards to making such an update to change to the listed marketing content, banner, and or promotional materials on your website and the Affiliate does not cure, rectify or reply to such request within sixty (60) days of notice we may reserve the right to re-direct your marketing materials and trackers, suspend , terminate and or withhold commissionable fees due to your account your ChipSplit account until such change has been rectified to our satisfaction.


Summary: While this is definitely a good change, I am still a bit worried about their ability to redirect trackers. Seems an odd punishment for not having up to date banners.

Terms Modification

If any modification is unacceptable to you, your only recourse is to terminate the agreement. You hereby consent that Gala Interactive (Gibraltar) Limited may unilaterally terminate, vary or transfer this Agreement . Your continued participation in the Affiliate Programme following such 30 day period will be deemed a binding acceptance of the modificationat any time.


Summary: This term essentially states that you will have 15 days after a terms change to either quit participating in the program - or accept the changes. Very odd... why 15 days?
