wingate affiliates - terms change

Well made the mistake to sign up there,
they have Europalace.com, a microgaming casino.
I was like huh, when I heard then that they DO carry over negatives,
this is why I not promote them much.

However, now I get an e-mail that they don't accept players from France anymore
Nothing unusual, but ... do I read that correct?
They say they close my account if I or a second Tier affiliate send them a player from France and French jurisdictions?

Umm, sorry, but I cannot control who visits my site, and it may always be that a player from France is trying to sign up there.
Is such a term ok? Did not see that from other casinos who announced that they not take France. Some did say like, you may not promote us on .fr domain..... well that is ok.

I writing to inform you that from Friday November 19th, EuroPalace.com will not be accepting new customers from France anymore (which includes all French jurisdictions).
In light of these developments we have made the following changes to the Wingate Affiliates terms and conditions:

9.9 By entering into this Agreement you undertake that you, or any Second Tier Affiliate will not:
(i) actively target Customers located in France, Guadeloupe, Martinique, French Guiana or Réunion including but not limited to sending Customers correspondence, the use of banners, off-line advertising and direct marketing; and
(ii) send Wingate Affiliates or any of its Merchant casino sites any traffic or players originating from France, Guadeloupe, Martinique, French Guiana ,Réunion, French Polynesia, Mayotte, New Caledonia, Saint Barthelemy, Saint Martin, Saint Pierre and Miquelon, Wallis and Futuna.

9.10 Wingate Affiliates reserves the right to immediately terminate this Agreement should you or your Second-tier Affiliate breach the abovementioned clause 9.9 and excludes to the fullest extent lawfully permitted all liability incurred pursuant to such a breach of the abovementioned clause 9.9
As always, we are looking out for your best interest and even if your traffic was predominantly French, we will make sure that this affects you as little as possible. Our partnership with you is very important and we will do our best to maximize your earnings without putting our client or your relationship with us at risk.
