Predatory Terms

1. Negative balances will default to zero at the beginning of the following month in order to give you a fresh start for the month provided you have at least 3 separate distinct and unique players playing for that month.

Affiliate Payment Date?: If you have an ECash Direct account with ECash Direct (UK) Limited, your earnings will be credited to your ECash Direct by the 15th day of each month. If you don't have an ECash Direct account, your check will be in the mail by no later than the 15th day of each month.

Negative Carryover?: Negative balances (your referred customers win during the month) will not be carried over to the following month. Negative balances will default to zero at the beginning of the following month in order to give you a fresh start for the month provided you have at least 3 separate distinct and unique players playing for that month.

Minimum Payment?: Please note, we will not mail checks until you have earned at least $250 in referral fees.

Revenue Share Percentage?:
You will earn a 25 - 35% commission based on the Adjusted Gross Revenue generated by the Customers you refer to the participating Focal Click online casinos.

Tiered Revenue Sharing?: From the Focal Click Affiliate Manager (Mark):

6-10 4% increase in commission

Our overall analysis: Focal Click has one clause that we deem predatory. If enforced, you COULD carryover negatives. This, in itself, does not lose players - so AffiliateGuardDog.com believes the T&C's for Focal Click are not overly predatory and are acceptable.

In regards to the predatory clause, I understand your concern. However, this is only used in these cases.

1. Say an affiliate has 2 players. In actuality this affiliate has a customer that has multiple accounts with 2 or more casinos. They loose $5K in one casino and then win $10K in another. Focalclick would have to pay on the losses and then zero out the wins. At this point, FC looses $5K and is still paying out to the affiliate. In this case, if you as an affiliate don't have 3 or more customers in the account, they cannot justify paying.

2. In the case where an affiliate has 1 customer in their account. The customer looses $5k in January, then wins $20K in February, and then looses $1K in March. If this is the only player in the account, Focalclick cannot justify paying in March, since overall they are down $14K on this player. They cannot justify paying on that players losses for March . If they have more customers in the account that are playing, Focalclick would pay.

These instances are rare and only happen once in a while, but they do happen. Focalclick can't justify paying on 1 customer in an affiliate account that is up on the casinos over the period of several months.


OUR RESPONSE: AffiliateGuardDog.com feels that this response is acceptable and certainly gives us a better feeling about the predatory clause (above). Thank you, Mark, for explaining how this rule would be enforced. The term is still considered a minor infraction and will remain listed as predatory. However, Focal Click T&C's are not (as a whole) predatory.
