ComeOn Connect T&C Update - Massive tracking link clause implemented

Be aware of this update they sneaked into the T&C as of 26th of Jan 2021
At least to me, this sounds like a very big clause in which they can use to shut down affiliates. Pretty much 100% of affiliates use cloaked tracking links right? In the updated T&C you can read this under section 2.1

2.1 It is a condition of this Agreement that you will not do any of the following:

(e) use the Tracking Links or Code in a way which proves or is likely to prove detrimental to ComeOn Connect such as purposefully hiding referral URL’s for customers referred to ComeOn Connect brands.

The email they sent out:

"Dear Affiliates,

First and foremost, we hope you're doing well. We're reaching out to you to inform you of some changes to our terms and conditions. These changes will be implemented with immediate effect, and our T&C page has been updated accordingly to show these changes.

The updates in question are the following:

"e) use the Tracking Links or Code in a way which proves or is likely to prove detrimental to ComeOn Connect such as purposefully hiding referral URL's for customers referred to ComeOn Connect brands.

ComeOn will of course claim that this is only to be used for X or Y, but we all know that when you place a revolving door clause like this they can use it for pretty much anything they want....

To clarify this clause does not prevent an affiliate using a link shortener to change how the link is viewed on site such as stephen.com/go/comeon. It is more if you are preventing the referrer URL being sent to us to so are not aware of where the links are placed and the customers are coming from.

This would be more from within the code stating for no referrer URL will be sent. So as long as we are getting the referrer URL sent to us from the player this is fine. The reason we are making this change is due to the ever-increasing compliance changes in many markets we need to know where exactly we are being advertised and that the places we are being advertised in are compliant with the regulations of that market.

This clause has always been in our T&Cs were merely updated it with this example. This has been emailed out along with a notification upon login to the account.

Hi Stephen,

Thanks for the quick response, and explanation.

I'm not saying Comeon would do the following... BUT... with clause/term e, it is open to abuse by the program. Hence, it should specifically state what clause/term e means, and does not mean, because, most affiliates cloak their referring URL's ;)

To leave it open to interpretation, is what the OP states is, a revolving-door clause.
